Companies could do something about this, but don't because it often costs less to pay than fight in court, and also these companies hold a lot of patents of their own, and don't want to create any legal precedent that will work against them in the future. This is great--in theory. In practice, sometimes "faking it" can have extremely real and terrible consequences, which these people found out the hardest of hard ways.
